By accessing or using Over The Phone ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Over The Phone provides AI-powered phone agent software that allows businesses to build, deploy, and manage automated calling workflows. The Service connects to third-party telephony and AI providers including but not limited to SignalWire and OpenAI.
3. Permitted Use
You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations, including but not limited to the Telephone Consumer Protection Act (TCPA), the FCC's rules regarding robocalls and prerecorded messages, and any applicable state telemarketing laws.
- You are solely responsible for obtaining all required consents before placing calls.
- You must honor all do-not-call requests immediately.
- You must not use the Service to harass, defraud, or deceive any person.
- You must not use the Service to place calls outside of legally permitted hours.
4. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized access.
5. Third-Party Services
The Service integrates with third-party providers. Your use of those providers is subject to their respective terms of service. We are not responsible for the availability, accuracy, or conduct of any third-party service.
6. Data and Privacy
Our collection and use of information is governed by our Privacy Policy. Call transcripts and recordings may be stored as part of the Service. You are responsible for disclosing this to callers as required by law.
7. Limitation of Liability
To the maximum extent permitted by law, Over The Phone and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
8. Changes to Terms
We may update these terms at any time. Continued use of the Service after changes constitutes acceptance of the revised terms.
